Terms and Conditions

The “Seller” is Natasha Stromberg on behalf of River Valley Enterprises Ltd. The term “Buyer” refers to the Buyer (student or client).

COURSES: TERMS OF SALE

Ordering

On receiving the Buyer’s order, the Seller will register the Buyer on the course and email the Buyer with further details regarding the scheduling of online or in-person coaching sessions/courses.

All orders for the course shall be deemed to be an offer by the Buyer to purchase the course pursuant to these Terms and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason. Where the course ordered by the Buyer is unavailable, the Buyer shall be notified and given the option either to wait until it becomes available or to cancel the order and receive a full refund within 30 days.

Applications will only be accepted with payment of the course/coaching session in fee in full. Also note that any deposits are non-refundable.

Price and Payment

The price of the course shall be that stipulated on www.natashastromberg.com. The course fees include all course materials and tuition and where stated, postal costs. The total purchase price will be displayed in the Buyer’s shopping cart prior to confirming the order.

Pre-payment is required for all bespoke workshops 14 days before workshop. The Buyer’s workshop is not guaranteed until payment is made.

Postage to outside of UK will incur extra charges.

Cancellation, Returns and Refunds

Withdrawal from the course by the Buyer: In the event of the Buyer wishing to withdraw from a course contract, no refunds will be made.

Course alterations by the Seller upon request of the Buyer

Any course alterations (such as a change of course date) requested of the Seller by the Buyer are at the Seller’s discretion. In any case, no refund will be given for changes or cancellations by the Buyer made with less than 28 days’ notice and under no circumstances will the deposit be refunded. If any additional costs are incurred as a result of altering the course, these additional costs shall be met by the Buyer.

Course cancellations/alterations by the Seller

If circumstances arise that are beyond the Seller’s control, it may be necessary to change/cancel course dates, content, venues and prices from those published. It should be noted that the Seller not be held liable for any costs/losses incurred as a result of any such changes. If the Seller is no longer able to provide the Buyer’s course, the Seller will ask the Buyer to return any course materials to the Seller (at the Seller’s expense) in the condition as originally delivered to the Buyer and refund to the Buyer any fees paid to date when the Seller received the materials as required.

Rights of the Seller

The Seller reserves the right to adjust the price of the courses at any time prior to an enrolment being processed. Should the Seller change the price of the course, the Buyer will have the opportunity to either cancel the enrolment or to proceed at the amended price.

The Seller reserves the right to adjust the specification of the course, or any aspect of the course, at its discretion.

The Seller reserves the right to withdraw the course at any time. Should the Seller withdraw the course after the Buyer has purchased it, the Seller shall refund the Buyer an amount agreed between the Seller and the Buyer.

Save as provided for in the preceding paragraph, the Seller shall not be liable to anyone for withdrawing the course or for refusing to process an order.

Indemnity and Limitation of Liability

Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the course and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

Nothing in these Terms shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller’s agents or employees.

The Buyer agrees to indemnify and keep indemnified the Seller, their successors and assigns, and each of their respective directors, officers, employees and agents from and against any and all liability, damages, losses, claims (including reasonable legal fees) resulting in any way from the Buyer’s use of or interpretation of the course and from any material posted on the course website, to its discussion groups or from any other matter relating to the course, including but not limited to use of the information contained in the course.

Waiver

No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

Force Majeure

The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lockouts, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

Severance

If any term or provision of these Terms is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms had been agreed with the invalid illegal or unenforceable provision eliminated.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

COACHING: TERMS OF SALE

Appointment

The Seller agrees to supply coaching services to the Buyer and the Buyer agrees to pay the fee for the same subject to these Terms. The exact date and time of the Seller’s supply of the services and of the amount of the fee shall be agreed in advance between the parties.

The Seller’s Obligations

The Seller shall endeavour to provide the services in accordance with these Terms. In the event that the Seller cancels the services or a session, as applicable, for any reason, the Seller shall offer the Buyer a new date for the services or the session and no additional fee shall be payable by the Buyer. If such date is not reasonably acceptable to the Buyer, the Seller will refund the fee in the event that the Buyer has already paid the same.

The Buyer’s Obligations

The Buyer shall: (i) co-operate with the Seller as reasonably necessary in order to enable the Seller to provide the services; and (ii) notify the Seller of if the Buyer has any special requirements relating to the services prior to the Seller providing the services.

Payment

For private session’s payment of the fee by the Buyer to the Seller shall be by via the payment page of www.natashastromberg.com or by bank transfer 48 hours prior to the date of the Buyer’s session. Payment of all sums shall be made in pounds sterling (£GBP).

Cancellation

In the event that the Buyer notifies the Seller that the Buyer wishes to cancel or postpone the services or the session prior to the time of commencement of the same, the Buyer shall do so 48 hours or more in advance of the scheduled session. If the Buyer notifies the Seller with less than 24 hours in advance of the next scheduled session, the full fee of the session is payable. If the Buyer has already paid for the same, the fee is not refundable.

Confidentiality

Confidentiality is an integral part of coaching and is seen as essential to building the coaching relationship. The coaching process encourages the Buyer to be as open and honest as possible and inevitably personal experiences and sensitive information is disclosed. It is vital therefore that the Buyer can trust that everything discussed will remain completely confidential. All information will remain confidential unless both the Buyer and Seller agree to discuss something with a third party. The only circumstance where confidentiality might be broken would be if there was a serious risk to the Buyer’s life or if another person’s life was at risk; alternatively, in the rare instance where the Seller was liable to civil or criminal court proceedings if they did not disclose Buyer’s information. If at all possible this would be discussed at length with the Buyer beforehand and everything would be done to safeguard Buyer confidentiality despite the extenuating circumstances.

Limitation of Liability

The Seller shall not be liable to the Buyer (excluding for personal injury or death, fraud, or wilful default) for any loss or damage (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, and whether in tort (including without limitation negligence, contract or otherwise) that may result in connection with the services. The Seller’s liability to the Buyer shall at all times be limited to the amount paid, if any, by the Buyer for the services.

The Buyer is aware that coaching is in no way to be construed as psychological counselling, therapy or financial advice. The Buyer enters into coaching with the full understanding that they are responsible for creating their own results.

Disclaimer

The content of the sites known as www.natashastromberg.com is not intended to substitute for professional advice. Coaching is not an alternative to the Buyer seeking professional advice and guidance.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with English law and the parties hereby agree to submit to the exclusive jurisdiction of the English courts.

Such links are maintained “as is” for information purposes only and Seller does not, therefore, necessarily approve of or endorse the content of those sites.

Quality Assurance

The Seller believes that the services or goods they offer are of excellent quality and the Seller makes every attempt to offer the most efficient service they can. This website, and any files or documents that the Buyer download from it, is not guaranteed to be free from any so-called computer viruses or malicious codes, and it is strongly recommended that the Buyer check for such viruses before down-loading it to their computer equipment.

Overseas (non UK) Customers

The Seller is a UK company based in England. All items on the Seller’s site are priced in UK Pounds Sterling (£). If UK Pounds Sterling (£) is not the Buyer’s currency, the amount the Buyer actually pays will vary depending upon the exchange rate at the time the transaction is processed. A fee from your own bank on foreign currency transactions may be applied. Please contact your bank/credit/debit card company for information on their fees.

Payment

All goods remain the property of Seller until full payment has been received and verified.

Changes to Terms

The Seller shall be entitled to alter these Terms at any time, but this right shall not affect the existing Terms accepted by the Buyer upon making a purchase.

Statutory Rights

Nothing in these Terms shall affect the Buyer’s statutory rights as a Consumer.

Legalities

All contracts made between Seller and the Customer is subject the English law and any disputes arising shall be subject to the sole jurisdiction of English courts. These Terms and conditions do not affect the Buyer’s statutory rights as a consumer.
